Terms of Service

These Terms of Service (the “Terms”) govern your use of zorver.com (the “Site”) and your participation in the Zorver reservation program. “Zorver,” “we,” “us,” and “our” refer to the Zorver business, operated from the State of Texas, United States. You can reach us at connor@zorver.com.

By using the Site, or by placing a reservation, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or place a reservation. You must be at least 18 years old and able to form a binding contract to place a reservation.

1. What a reservation is — and what it is not

A Zorver reservation is a refundable deposit of $10 USD per necklace that holds your place in the Founding Member program. Placing a reservation secures, for each necklace reserved:

• Founding Member pricing — $149 off the regular retail price of any finish;
• three months of Zorver membership included at no charge, with the membership price after that disclosed at the time of purchase;
• priority delivery — Founding Members receive their units before the general release.

Founding Member benefits are limited to the first 5,000 reserved necklaces. The availability counter shown on the Site reflects actual paid reservations.

A reservation is not a purchase. It is not an order for a product, does not transfer ownership of anything, and does not obligate you to buy a Zorver necklace or obligate Zorver to sell you one. It reserves the opportunity to purchase on Founding Member terms when the product becomes available. You will never be charged the remaining balance automatically; purchasing the necklace will be a separate, deliberate transaction that you choose to complete (or not) at that time.

2. Refunds and cancellation

Your reservation deposit is fully refundable at any time before you complete a purchase. To cancel, reply to your confirmation email or write to connor@zorver.com from the email address used for the reservation. We will refund the full amount you paid to your original payment method, normally within 5–10 business days of the refund being issued by our payment processor.

Zorver may also cancel your reservation or discontinue the reservation program at any time — for example, if the product cannot be brought to market — in which case you will receive a full refund of your deposit. A full refund of amounts you paid is the exclusive remedy for any cancellation, by either you or us.

3. The product is in development — nothing shown is final

Zorver is a pre-production product. All product images on the Site are design renderings, and all app screens shown are previews; neither depicts a final product. The final necklace and app may differ from what is shown today, including in appearance, dimensions, materials, finishes, features, sensors, measured metrics, software capabilities, membership features, packaging, and specifications. Offered finishes may change, and you may change your selected finish before production begins.

The shipping timeframe shown on the Site (currently Spring 2027) is a good-faith estimate, not a guaranteed date. Hardware development timelines can move. If the estimate changes materially, we will notify the email address on your reservation, and you can cancel for a full refund at any time, as always.

4. Future purchase and crowdfunding launch

When the product is ready for sale, we will contact you with the opportunity to complete your purchase on Founding Member terms. The purchase itself will be governed by the purchase terms presented at that time. Zorver may launch the product through a crowdfunding platform (such as Kickstarter) or through its own store; your reservation and its benefits apply in either case, and we will explain the exact mechanics when we contact you. If you choose not to purchase, you can request a refund of your deposit.

5. Not a medical device

Zorver is a general wellness product. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease or condition, and no feature described on the Site has been evaluated by the U.S. Food and Drug Administration. Information provided by Zorver — on the Site, in the app, or from the product — is not medical advice. Always consult a qualified health professional for medical concerns, and never disregard professional medical advice because of information from Zorver.

6. Payments

Payments are processed by Stripe, Inc. Zorver does not receive or store your card number. Your payment is also subject to Stripe’s terms and privacy policy. All amounts are in U.S. dollars.

7. Using the Site

You agree not to misuse the Site — including attempting to interfere with its operation, accessing it by automated means to place reservations, submitting false information, or infringing the rights of others. All content on the Site — text, images, renderings, logos, and the Zorver name — belongs to Zorver or its licensors and may not be used without permission.

8. Communications

By placing a reservation you agree to receive transactional emails about your reservation (confirmations, receipts, refunds, material updates) and occasional updates about Zorver’s progress. Every non-transactional email includes a way to unsubscribe. Unsubscribing from updates does not affect transactional messages about your reservation.

9. Disclaimers

The Site and the reservation program are provided “as is” and “as available.” To the fullest extent permitted by law, Zorver disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that the product will be brought to market.

10. Limitation of liability

To the fullest extent permitted by law, Zorver’s total liability arising out of or relating to these Terms, the Site, or the reservation program is limited to the amount you paid to Zorver, and Zorver will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Dispute resolution and arbitration

Most concerns can be resolved quickly and personally — email connor@zorver.com and we will work with you in good faith. If a dispute cannot be resolved informally within 60 days, you and Zorver agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The Federal Arbitration Act governs this section.

Class action waiver: disputes will be arbitrated only on an individual basis; neither party may participate in a class, consolidated, or representative action.

Your right to opt out: you may opt out of this arbitration agreement by emailing connor@zorver.com with the subject “Arbitration opt-out” within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Subject to Section 11, any proceeding shall be brought in the state or federal courts located in Texas.

13. Changes, assignment, and other terms

We may update these Terms from time to time; the effective date above always reflects the current version, and material changes affecting existing reservations will be communicated by email. Changes do not reduce the refundability of a deposit you have already paid. Zorver may assign these Terms and your reservation to a successor entity that continues the Zorver business (for example, a company formed to operate Zorver); your rights, including refundability, carry over unchanged. You may not assign your reservation without our consent. If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and Zorver regarding the reservation program.
